These Terms and Conditions govern your relationship with MB Distribution (Cleveland) Ltd T/A MB DIY (the “Company”, “we”, “us”, “our”), a business registered in the United Kingdom. Please read these Terms and Conditions carefully before using our websites (this includes www.mbdiy.co.uk,www.lockmaster.co.uk, www.mbdecor.co.uk, www.dumapanels.co.uk and www.voxpanels.co.uk) or for purchasing goods via telephone or in-store.

By accessing or using our websites or by purchasing products from us, you agree to be bound by these Terms and Conditions. If you disagree with any part of the Terms and Conditions, you may not purchase from our websites or directly purchase products from us.

1. Products and Services

1.1 We offer a variety of DIY products, tools, and related services. All products and services available on our websites are subject to availability and may be amended without notice.

1.2 We reserve the right to modify or discontinue any product or service without prior notice. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of a product or service.

2. Pricing and Payment

2.1 All goods remain the property of MB Distribution (Cleveland) Ltd until paid for in full.

2.2 We accept payment through various payment methods, including credit cards, debit cards, and other online payment systems. By submitting your payment information, you warrant that you are authorised to use the designated payment method and grant us the right to charge your payment method for the total amount of your order (including any applicable taxes and shipping fees).

2.3 Prices quoted verbally or on our price list are net of VAT.

2.4 All products carry a recommended retail price, when selling our products online this RRP should be adhered to and should not be reduced by more than 5%. This reflects the quality of the MB product being sold. Any suppliers who are using our dropship services and are to be found selling below this price bracket will be contacted to discuss action. 3. Delivery and Returns

3.1 We aim to deliver your order within the estimated delivery timescale provided at the time of your order. However, delivery timescales are not guaranteed, and we are not responsible for any delays caused by postal or courier services.

3.2. For in-store and telephone orders with a local* delivery address that are under £50.00 these will incur a delivery charge of £5.00. *Locality dictated at point of purchase.

3.3 We must be notified of any shortages within 24 hours of delivery.

3.4 Any damages or errors should be reported to MB DIY within 24 hours of receiving the goods. After this window, the standard returns policy will apply, and return charges will be borne by the customer. Damaged items should be photographed and emailed to MB DIY within this 24-hour period. If items delivered by our MB delivery fleet are damaged or incorrect, you may refuse and return to our driver upon delivery. Please inspect all goods on arrival, as we cannot accept returns post fitting, and MB will not be held liable for any fitting or refitting labour costs. Goods that are opened or fitted cannot be returned or exchanged.

3.5 If you have simply changed your mind our office must be notified of all products that are to be returned, you will then be advised of how to proceed. All goods must be returned within 28 days of the date of the sale, unopened and in original packaging where applicable and in the same condition as received for any refunds to be applied. Customers are responsible for returning any items to MB DIY, this involves carriage charges and courier arrangements.

Reporting Returns

3.6 To report and initiate a return, please contact the MBDIY customer service team via email: sales@mbdiy.co.uk or telephone 01642 455945 option 2. Once your return is approved, we will provide you with further instructions on how to send your return. MB may be able to collect your item for a fee – this will be discussed when you report the return.

Credits / Refunds

3.7 Refunds or credits will be issued for items successfully returned to MB DIY. Refunds will be processed within 14 days after we receive and inspect the returned item(s). MB DIY will issue a credit note (for credit accounts) or a refund (for retail customers), where applicable. Refunds will be issued in the original payment method used at the time of purchase. MB will refund the customer the cost of the goods only, carriage fees are non-refundable, and the cost of return shipping will be the responsibility of the customer unless the return is due to our error in the incorrect goods being despatched or a faulty product. Whatever your reason for returning a product, we ask that you please observe a duty of care towards the goods; please ensure that the product is clearly labelled – see details required above.

3.8 Please note that some Special Orders are not refundable. Please check the individual product and ensure that it is to your requirements before purchasing.

3.9 If an order is; cancelled post-despatch, no longer required or surplus items are returned, carriage charges will not be refunded.

3.10 Any items returned in poor condition may not be refunded in full. This constitutes as restocking charges. MB DIY reserves the right to refuse a refund if items are deemed unusable.

Restocking Charge

3.11 MB DIY reserves the right to apply a re-stocking charge on returned items for reasons including, but not limited to:

• Arrival with damaged packaging
• Items returned without original packaging where applicable.
• Items that are not stocked by MB (special order items,oneoff items, or bathroom furniture items)
• Discontinued batched items

The specific restocking percentage may vary based on the product’s manufacturer.

Dropship Orders – Standard Returns

Items drop-shipped by MB DIY adhere to the above guidelines. Traders are responsible for ensuring their customers are aware of this return policy. While returns are primarily arranged by the trader, MB DIY may offer a pick-up service in specific cases. Arrangements and costs are to be discussed with our sales team.

Dropship Orders – Damages

Given the nature of dropship services, MB DIY acknowledge the potential challenge in reporting damages within 24 hours. However, traders must procure evidence of damaged goods from their customers within this timeframe and relay this information to MB DIY within an additional 24 hours.

4. Accounts and Invoices

4.1 Our terms of trade are strictly nett monthly, i.e. payments are due the end of the month following the month of invoicing. eg March invoices due end of April.

4.2 We must be notified of any invoice queries within 30 days of the invoice date. Please notify accounts@mbdiy.co.uk and we will then liaise with our sales team.

4.3 An administration charge of £20 will be applied to your account in the event of any cheques being returned unpaid or represented.

4.3 If your account reaches its credit limit before your next payment is due you will be required to make a payment off your account in the event of any additional orders being placed.

4.4 In the event of payment for any goods being overdue all monies outstanding become payable on demand.

4.5 We reserve the right to withdraw credit at any time and place overdue account on hold pending payment of overdue balances.

4.6 Prices are subject to alteration however all customers will be informed in advance with a price increase notification either via post or email.

4.7 We use Goodwins Credit Management Ltd – Caveat. If full payment is not made within our terms (30 days) collection will be passed to our third-party debt recovery specialists where a charge of 15% plus VAT will be incurred on the unpaid amount. Additionally, ‘Statutory Interest’ will also be applied to the unpaid amount.

5. Intellectual Property

5.1 All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of the Company or its content suppliers and is protected by copyright, trademark, and other applicable laws.

5.2 You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its content without the express written permission of the Company.

6. Limitation of Liability

6.1 To the maximum extent permitted by law, in no event shall the Company or its suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages, or any damages whatsoever, arising out of or in connection with the use, inability to use, or performance of the Site, the products, or any information or services provided through the Site.

6.2 MB DIY aims to deliver goods within a specified time; however, this is not a guarantee. If any fitting labour is lost due to delayed delivery times MB DIY cannot be held liable.

6.3 We aim to deliver products which are a high quality, if for any reason this quality isn’t of standard, this should be identified before installation. MB DIY cannot be held liable for labour costs or loss of earnings due to replacement of any items received.

6.4 All marketing material, images and samples provided by us are correct to our own knowledge. If there are any discrepancies with our marketing material or colour variation within products, we will try to correct this information, however we cannot be held liable for any loss due to these issues. The final responsibility falls with the parties selling direct to the end user of the product.

7. Governing Law and Jurisdiction

7.1 These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

7.2 Any disputes arising out of or in connection with these Terms or your use of the Site or the purchase of our products shall be subject to the exclusive jurisdiction of the courts of the United Kingdom. By using the Site or purchasing our products, you consent to the jurisdiction and venue of such courts.

8. Changes to Terms and Conditions

8.1 We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms and Conditions at any time. It is your responsibility to periodically check our Site for any changes. Your continued use of or access to the Site following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.

9. Severability

9.1 In the event that any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions. The validity and enforceability of the remaining provisions shall not be affected.
